Article 1: General provisions

The e-commerce website of the Students’ Association Industria, a non-profit organisation with its registered office at Andreas Vesaliusstraat 13, 3000 Leuven, VAT BE 0459.261.940, RPR Leuven, (hereinafter ‘Industria’) offers its customers the possibility to purchase the products from its web shop online.

These general terms and conditions (“Conditions”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order via Industria’s web shop, the Customer must explicitly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions to the exclusion of all other terms and conditions. Additional terms and conditions of the customer are excluded, unless these have been previously, explicitly and in writing accepted by Industria.

Article 2: Price

All prices stated are in EURO, and always include VAT and all other compulsory charges or taxes to be borne by the Customer.

If any delivery, reservation or administrative costs are charged, this will be stated separately.

The price stated relates exclusively to the articles as described word for word. The accompanying photos are for decorative purposes only and may contain elements not included in the price.

Article 3: Offer

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer do not bind Industria. Industria is only bound to a best efforts obligation with regard to the accuracy and completeness of the information offered. Industria is in no way liable in case of obvious material errors, misprints or printing errors.

If the Customer has specific questions about e.g. sizes, colour, availability, delivery period or delivery method, we request that the Customer contacts our customer service department first.

The offer is always valid while stocks last and can be modified or withdrawn by Industria at all times. Industria cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is made under conditions, this will be explicitly stated in the offer.

Article 4: Online purchases

Products are ordered via the webshop. All products are in digital form. Often this is a digital ticket for an event. The Customer can order a product by going to the desired event. There the Customer can order an admission ticket. To do this, the customer must fill in some information. Which data is needed is different for each event.

After filling in the details, the order is completed by an online payment. As soon as the online payment has been completed successfully, the Customer will receive the digital product by e-mail.

The Customer has the choice between the following payment methods:

Industria is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders involving the Customer.

Article 5: Delivery and performance of the contract

Articles ordered via this web shop will be sent to the Customer via email at the latest one day after payment.

Any visible damage and/or qualitative shortcomings of an article or other shortcomings in the delivery must be reported to Industria by the Customer immediately.

The risk due to loss or damage is transferred to the Customer as soon as he (or a third party appointed by him, who is not the carrier) has received physical possession of the goods. However, the risk already passes to the Customer upon delivery to the transporter if the transporter is instructed by the Customer to transport the goods and this choice was not offered by Industria.

Article 6: Reservation of ownership

The delivered items remain the exclusive property of Industria until the moment of full payment by the Customer.

If necessary, the Customer undertakes to inform third parties of Industria’s retention of title, e.g. to anyone who may seize the items that have not yet been paid for in full.

Article 7: Right of withdrawal

The provisions of this article only apply to Customers who purchase items online from Industria in their capacity as consumers.

The Customer has the right to revoke the agreement within a period of 14 calendar days without stating reasons.

The withdrawal period will end 14 calendar days after the day the agreement is concluded.

To exercise the right of withdrawal, the customer must inform Student Union Industria, Andreas Vesaliusstraat 13, 3000 Leuven, +32 16 30 10 48, info@industria.be, of his/her decision to withdraw from the agreement by means of an unequivocal statement (e.g. written by post, fax or e-mail). The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.

In order to meet the withdrawal deadline, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must send back the goods or hand them over to Industria, Andreas Vesaliusstraat 13, 3000 Leuven, without delay and in any case no later than 14 calendar days after the day on which he communicates his decision to revoke the agreement to Industria. The Customer is on time if they return the goods before the period of 14 calendar days has expired. In the case of digital goods, e.g. an admission ticket, the digital goods will be declared after the customer has communicated his decision to withdraw from the agreement.

The direct cost of returning the goods will be borne by the Customer.

If the returned product has diminished in value in any way, Industria reserves the right to hold the Customer responsible and claim compensation for any diminution in the value of the goods that is the result of the Customer using the goods in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items that are in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase may be returned.

If the Customer revokes the agreement, Industria will refund all payments received from the Customer up to that point, including the standard delivery costs, within a maximum of 14 calendar days after Industria is informed about the Customer’s decision to revoke the agreement. With sales agreements Industria can wait with the refund until they have received all the goods back or until the Customer has proven that he has sent back the goods, whichever comes first.

Any additional costs as a result of the Customer choosing another way of delivery than the cheapest standard delivery offered by Industria will not be refunded.

Industria will reimburse the Customer with the same means of payment the Customer used for the original transaction, unless the Customer has explicitly agreed otherwise; in any case the Customer will not be charged for such reimbursement.

Article 8: Warranty

Under the Act of 21 September 2004 on the protection of consumers in respect of the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

In order to make a claim under the guarantee, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer must contact Industria customer service and return the item to Industria at their own expense.

If a defect is established, the Customer must inform Industria as soon as possible. In any case, each defect has to be reported within a period of 2 months after it has been established by the Customer. After this period, any right to repair or replacement lapses.

The (commercial and/or legal) warranty is never applicable to defects that occur as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or changes to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that become apparent after a period of 6 months following the date of purchase, or delivery if applicable, are deemed not to be hidden defects, unless the Customer can prove otherwise.

Article 10: Penalties for non-payment

Without prejudice to Industria’s other rights, in the event of non-payment or late payment, the Customer is liable to an interest of 10% per year on the unpaid amount, ipso jure and without a warning. Furthermore, the Customer is liable to a fixed compensation of 10% of the amount involved, with a minimum of 25 euros per invoice, by law and without a warning.

Without prejudice to the above, Industria reserves the right to take back the items that are not (fully) paid for.

Article 11: Privacy

The party responsible for processing, Industria, respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data.

The personal details provided by you will only be used for the following purposes: implementing the agreement entered into, processing the order.

You have a legal right to inspect and possibly correct your personal data. Subject to proof of identity (copy of your identity card), you can obtain a written, dated and signed request to Industria, Andreas Vesaliusstraat 13, 3000 Leuven, info@industria.be, free of charge, for your personal details. If necessary, you can also request that data that is incorrect, incomplete or irrelevant be corrected.

In case of use of data for direct marketing: You can object free of charge against the use of your data for direct marketing. To do so, please contact Industria, Andreas Vesaliusstraat 13, 3000 Leuven, info@industria.be.

We treat your details as confidential information and will not pass them on, rent or sell them to third parties without the explicit consent of the Customer.

The Customer is personally responsible for keeping his login data confidential and for the use of his password. Your password is stored in encrypted form, Industria therefore has no access to your password.

Industria keeps online (anonymous) visitor statistics in order to see which pages of the website are visited and to what extent.

Article 12: Use of cookies

During a visit to the site, “cookies” may be placed on the hard drive of your computer. A cookie is a text file that is placed by a website server in your computer’s browser or on your mobile device when you consult a website. Cookies cannot be used to identify individuals; a cookie can only identify a machine.

First party cookies are technical cookies that are used by the visited site itself and which aim to make the site function optimally. For example: settings that the user has made during previous visits to the site, or a pre-filled form with data that the user has made during previous visits.

You can set your Internet browser so that cookies are not accepted, that you receive a warning when a cookie is installed or that the cookies are subsequently removed from your hard disk. You can do this through your browser settings (via the help function). Please note, however, that certain graphic elements may not appear correctly or that you may not be able to use certain applications.

Article 13: Impairment of validity – non-waivers

If any provision of these Terms and Conditions is declared invalid, unlawful or null and void, this will not affect the validity, lawfulness and applicability of the other provisions in any way.

Failure by Industria at any time to enforce any of the rights listed in these Terms and Conditions, or to exercise any of these rights, will never be seen as a renunciation of such a provision and will never affect the validity of these rights.

Article 14: Change of conditions

These terms and conditions are supplemented by other terms and conditions that are explicitly referred to, and the general sales terms and conditions of Industria. In the event of contradiction, the present terms and conditions take precedence.

Article 15: Proof

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law – Disputes

Belgian law shall apply, with the exception of the provisions of international private law concerning applicable law.

The courts of the Consumer’s place of residence have jurisdiction in the event of legal disputes. The Consumer may also turn to the ODR platform (https://ec.europa.eu/consumers/odr/).
